PEDOPHILE LESBIAN WHO ALSO LIKES “LITTLE GIRLS” Justice Francesca Marzari of the Supreme Court of British Columbia, Canada, declared a father guilty of “family violence” against his 14-year-old daughter on the sole basis that he had engaged in “expressions of rejection of [her] gender identity.” These “expressions” revolved entirely around his polite refusal to refer to his daughter as a boy in private, and his steady choice to affirm that she is a girl in public.

Hoping to raise awareness of his case, Clark gave a number of interviews to media outlets, including The Federalist. In these interviews, he repeatedly referred to his daughter as a girl, stating to The Federalist that “she is a girl. Her DNA will not change through all these experiments that they do.”
While many might take this to be an honest statement of biological fact, Marzari quoted it as a prime example of Clark’s “family violence of a public denial of [Maxine’s] gender identity.” Marzari convicted Clark of this violence, and issued a “protection order” preventing him from speaking to journalists or the public about his case.
[…]What Marzari found particularly egregious, however, was not Clark’s private interactions with his daughter but his “continued willingness to provide interviews to the media … in which he identifies [Maxine] as female, uses a female name for [Maxine] … and expresses his opposition to the therapies [Maxine] has chosen.” According to the court, this willingness placed Maxine at “a significant risk of harm.”

The court also emphasized that Clark must not allow relevant documents (petitions, affidavits, letters, court orders, etc.) to come into the hands of third parties not “authorized by order of this court,” or with “written consent” from his daughter.

In a series of decisions over the past year, a Canadian court in British Columbia has ruled that a 14-year-old girl who believes she is “transgender” can go through medical procedures to “change” her sex to a boy – despite her father’s fierce objections.
These procedures include puberty-blockers and opposite-sex hormones. According to the hospital’s own consent forms (which the father refused to sign), these drugs are experimental and will cause sterility and other dangerous side effects, such as unhealthy bone growth. The effects are irreversible. But the court is ignoring those dangers. At this point, the father reports his daughter is already growing facial hair and has a deepened voice.
The court has severely clamped down on public reporting of this. The father is prohibited from discussing the case with media (or anyone else who might publish his remarks). He is banned from mentioning his own name, his daughter’s name, or the names of any of the doctors involved with the medical procedures, in regard to this case. Anyone in Canada who has posted articles or videos that disobey that ban has been ordered to remove them under threat of arrest.
The case has made national news in Canada and is celebrated by the liberal media, which have no problem abiding by the ban and edit their articles appropriately.

But the terms of the divorce give the father and mother equal say in the daughter’s medical decisions. According to reports, at first the mother was against these experimental treatments. Yesterday, Bryan Fischer brought Joseph Sciambra onto Focal Point to discuss Sciambra’s new book, Swallowed By Satan, which is a tale of his journey out of homosexuality, neo-Nazism, and Satan worship. Like other ex-gay activists, Sciambra offers harrowing accounts of early sexual trauma, drug abuse and risky sexual behaviors, including public sex and flashing men.
While Sciambra says he identified as gay, he also claims he was obsessed with female pornography (describing it as a “succubus”) and regularly frequented female sex workers and brothels. Sciambra explains that he began to sleep with men because “women did not have the physical strength for the type of abuse I needed,” and as a result he fell into Satan’s digestive tract until “my continued presence in his bowel became an irritant [and] I was passed out”:

Magnus Hirschfeld coined the term transsexualism,[6] identifying the clinical category which his colleague Harry Benjamin would later develop in the United States. Transgender people were on the staff of the Institute, as well as being among the clients there. Various endocrinologic and surgical services were offered, including the first modern sex reassignment surgeries in the 1930s. Hirschfeld also worked with Berlin’s police department to curtail the arrest of cross-dressed individuals, including those suspected of wearing certain clothing in connection with sex work, through the creation of transvestite passes issued on behalf of the Institute to those who had a personal desire to wear clothing associated with a gender other than the one assigned to them at birth.[7][8]
Hirschfeld was a groundbreaking sexologist. Stonewall Society writes that Hirschfeld was Jewish, gay, liked wearing women’s clothing (and created the word “transvestitism”) and was a foot fetishist to boot. Hirschfeld saw sexuality as a natural phenomenon worthy of academic research, as opposed to a shameful thing.
During his lifetime, Hirschfeld wrote and collected a ton of texts about queer sexuality, including many works about trans identity. Hirschfeld’s colleagues practiced gender reassignment surgery.
The Institute of Sex Research was opened in 1919 by Magnus Hirschfeld and his collaborator Arthur Kronfeld,[3] a once famous psychotherapist and later professor at the Charité. As well as being a research library and housing a large archive, the Institute also included medical, psychological, and ethnological divisions, and a marriage and sex counseling office. The Institute was visited by around 20,000 people each year, and conducted around 1,800 consultations. Poorer visitors were treated for free. In addition, the institute advocated sex education, contraception, the treatment of sexually transmitted diseases, and women’s emancipation.
When Hirschfeld was out of Germany on tour, the Nazi student group marched on the Institute. Over 20,000 books were set aflame, as well as medical diagrams and photographs crucial to understanding sex reassignment surgery. Hirschfeld and his colleagues were Jewish.
The Institute became a point of scientific and research interest for many scientists of sexuality, as well as scientific, political and social reformers in Germany and Europe, particularly from socialist, liberal and social-democratic circles. In 1923 the Institute was visited by Nikolai Semashko, Commissar for Health in the Soviet Union. This was followed by numerous visits and research trips by health officials, political, sexual and social reformers, and scientific researchers from the Soviet Union interested in the work of Hirschfeld.[4] In 1926 a delegation from the institute, led by Hirschfeld, reciprocated with a research visit to Moscow. In 1929 Hirschfeld presided over the third international congress of the World League for Sexual Reform at Wigmore Hall.[5

Even their website URL is carefully crafted to leverage specific keywords so that their clinic will come up first in a Google search (https://ftmtopsurgery.ca), and their frequent blog posts are rich with targeted keywords to ensure their website will remain at the top of Google search results,” Buffone explained.
“They’ve designed a marketing strategy around an extremely vulnerable group of young people and we filed the complaint to raise this issue to the College of Physicians and Surgeons so they can decide whether this is in breach of their professional standards.”
Some of the photos that appear on the McLean clinic’s Instagram account show the results of gender surgeries, particularly shirtless post-surgery young women who have had their breasts removed, bearing their scars. One such image shows McEvenue wearing both a surgical mask and a Santa hat while holding up two small buckets labeled “breast tissue.”
“The patient information disclosed on the McLean Instagram site is protected health information per Section 4 of the Personal Health Information Protection Act (PHIPA),” the complaint states, and the clinic is disclosing information that identifies an individual, or, according to the text of the law, “for which it is reasonably foreseeable in the circumstances that it could be utilized, either alone or with other information, to identify an individual.”
Posting such content contravenes CPSO guidelines, which state that doctors ought to consider how technology use can cause the public to view them as unprofessional, the complaint goes on to say, noting how the amputated breasts and body tissue of patients are not treated with dignity in the Instagram photos and that many such patients seem to be minors.
The complaint concludes by asking CPSE to order McLean and McEvenue to stop their posting of material that violates PHIPA patient privacy requirements for trans-identifying persons on social media and to clarify the ethical requirements for members about the marketing of surgical procedures to minors, particularly those who may be suffering from mental illness or gender confusion.

Transgender people in British Columbia will soon have (NOW HAS) access to publicly funded gender-affirming lower surgeries within the province, as British Columbia becomes the first province in western Canada to offer these procedures next year.
“The trans community has advocated over a number of years for improved access to care, including access to complex lower surgeries within B.C.,” said Adrian Dix, Minister of Health. “For those seeking lower surgery, people were required to travel to Montreal or to the U.S., resulting in additional medical risks associated with travelling long distance after surgery and in receiving followup care if there were complications.”
Reconstructive gender-affirming surgeries will be available within Vancouver Coastal Health starting in 2019. In addition, trans people throughout the province now have improved access to publicly funded gender-affirming chest and breast surgeries. A total of 14 surgeons INCLUDING DR. BRENDEN HURSH will provide these surgeries in Burnaby, Kamloops, Kelowna, Port Moody, Prince George, Vancouver and Victoria.

Surgery on reproductive organs is expensive, so many people leave them alone. That means a trans man with a uterus — or a trans woman with a prostate — might have to endure embarrassing, awkward questions from health care providers when getting regular care, such as an annual physical.
Baker had no trouble providing examples.“What do you mean you need a cervical Pap test for a man or a prostate exam for a woman?” he asked. “How do we compute that? You shouldn’t have that part, so we don’t know what to do with you.”
Those were the kinds of questions Yee Won Chong had to face when he was diagnosed with stage 2 breast cancer. He had undergone what’s known as top surgery, where breast tissue is removed and the chest is reconstructed to a more masculine appearance. However, he later developed cancer in the remaining breast tissue. His doctor didn’t know how to code him into the medical records system.
“I’m her first transgender patient,” Chong explained. But he was lucky. His oncologist, Dr. Tammy De La Melana, committed herself and her office team to the best possible care for Chong. And in a coincidence that Chong described as freaky, his roommate, who is also transmasculine, discovered he had ovarian cancer. They’re working now on a documentary about their experiences, called Trans Dudes with Lady Cancer.
Murphy: When we’re talking about policy changes and legislation we really need to start speaking up and have this debate. I mean, the [transgender] ideology is incoherent, insane, and frankly, sexist. It doesn’t make sense that you can be born in the wrong body. It does not make sense that you can be a man but actually be a woman “on the inside.” These are not coherent, rational ideas based on science. You cannot change sex; it’s simply not possible.
Young Canadians are being sold ‘gender-affirming’ top surgery on Instagram
Barbara Kay, 4 weeks ago 10 min read Author’s note: I am grateful to the recently-launched caWsbar (Canadian Women’s Sex-based Rights) for bringing the McLean Clinic, and its aggressive marketing techniques, to my attention, as well as for files they contributed to this column. Dr. Alicia Hendley, Phd in psychology and founding member of caWsbar told me: “We’re very alarmed about the current trend of young women having double mastectomies to treat their dysphoria. We urge medical professionals to move beyond the external pressures they are being faced with and to put into action their most sacred principle—first do no harm.”
The rapid escalation of gender-fluid identification amongst young people in the West is nothing short of astounding. Adolescent females are now in a majority of those seeking transition. An Ottawa clinic, CHEO, used to see one or two patients a year. Last year it saw 189. It’s the same in other provinces:
Girls who are dissatisfied with their post-puberty bodies and wish to present as boys, naturally focus on their burgeoning breasts. They may use binders to flatten them, or they may seek surgical removal, referred to in the gender-fluidity world as “top surgery.”
Until fairly recently, a patient needed to undergo psychiatric testing before receiving OHIP approval for funding. Now a patient can be diagnosed by a GP or any other “expert” in gender health. Effectively, OHIP is now approving funding for any teenager who self-diagnoses as gender dysphoric, since Ontario law forbids any health professional from practicing “conversion therapy.” That is, any attempt by a doctor to inquire into contributing factors such as autism, anxiety, sexual preference, depression or other influencing factors could easily be construed as illegal.
The primary destination for top surgery in Ontario is the McLean Clinic, run by Dr. Hugh A. McLean, who has himself performed hundreds of top surgeries and who is not shy about promoting his clinic as a place where gender-fluidity dreams come true.
On the clinic’s Instagram page you can see dozens of photos of post-op FTM (female-to-male) clients posing bare-chested and happy. The clinic cheers on their patients—and prospective patients—with encouraging posts such as “Postop one day! What a way to start the holiday season. Nice job, Dr. McLean!” and “Ready for a topless summer.” Some of the females seem extremely young. Other adolescents comment, “I can’t wait to have this surgery too!” “I’m jealous!” In one photo, fellow surgeon Dr. Giancarlo McEvenue (more on him anon) wearing a mask and a Santa Claus hat holds up two buckets labelled “Breast tissue,” accompanied by a Dr McLean post: “For all you good boys, Dr McEvenue is not bringing gifts, he’s taking them away!”
We already know that adolescence is a notoriously labile period in the maturation cycle, and that teenagers under the age of 18 (at a minimum—our brains are not fully mature until 25) cannot be assumed to be making momentous decisions with truly “informed consent.” This Instagram page straddles a line between affirmation and recruitment.
Dr. McEvenue, Dr. McLean’s (until recently) colleague at the McLean clinic (he is listed as a surgeon here now), is as well a paid consultant for Johnson & Johnson, whose products and services are employed in these surgeries. Under their sponsorship, Dr. McEvenue participated in a gender reassignment surgery panel last September in Markham, Ontario. You can watch the panel and his performance here.
In the video, you see a marked transformation in Dr. McEvenue’s pitch. He’s jettisoned the Instagram-friendly Santa hat and the buckets of breast tissue. He is now the smooth, Madman-esque embodiment of Corporate Guy, representing a mammoth company that brands itself as so LGBT-friendly they are bursting with Pride and self-congratulation.
Dr. McEvenue tells us that there could be as many as two million people with gender dysphoria in Canada – about 1.5% of the population – considerably more than the DSM-5’s estimation of .002-.003%. Not only is the wish for top surgery not indicative of a disorder, he says, but it is even “not a distress,” and in fact it may not be necessarily exclusively related to gender dysphoria. Sometimes it is just “breast dysphoria,” he says, a term new to me, which turns out to mean that “you don’t like your breasts.” If that is your issue, Dr. McEvenue is there for you, and will remove them. Because he has a “passion” for what he does.
At the 14:30 minute mark, Dr. McEvenue inadvertently demonstrates the health community’s general dumbing-down of the transition process that he is abetting.
He says, “Believe it or not, when a patient wanted top surgery five or ten years ago, they had to go to a psychiatrist to get diagnosed.” (Here he grins, presumably at the craziness of the very idea that a woman wanting to lop her breasts off might benefit from sorting through her motives with a mental health expert). He continues, “If a woman comes to me for breast augmentation, I don’t make her go to a psychiatrist. I say, okay, are you an adult? Do you understand the surgery?” (laughter, applause. This audience really really wants to believe that top surgery on teenage girls is no big deal.)
So let’s unpack these statements. Dr. McEvenue is comparing breast removal to breast augmentation as though they were two sides of the same coin. But they’re not. The parallel to a breast augmentation is a breast reduction. Both surgeries are performed on women who identify as women, but for reasons of comfort (reduction) or perceived enhanced sexual allure (augmentation), seek surgical alterations. Of course such women do not require psychiatric evaluations. How is augmentation in any way logically comparable to top surgery for transitioning girls who want their breasts removed so they can present as male? It isn’t, unless you are attempting to trivialize both the operation and its psychological implications.
Furthermore, he asks his augmentation patients, “are you an adult?” But from the photos on the Instagram account, a great number of Dr. McEvenue’s patients are not adults at all. How does he know they truly understand what they are doing? Why wouldn’t he want them to see a psychiatrist beforehand? If they are sure of what they are doing, what harm can deeper exploration do? And if they are not sure, what’s the down side of them changing their mind? There is a long waiting list at the McLean Clinic, according to Dr. McEvenue. If one or two drop off it after consulting with a mental-health expert, where’s the tragedy there? Dr. McEvenue claims it is a matter of “respect” not to challenge his patients’ self-diagnosis. And at the 18-minute mark, he says, “Why would I send [a patient] for a second opinion?” Yet “second opinions” are standard in every other field of surgery, and no other surgeons consider them a sign of disrespect. (I guess it’s a good thing Dr. McEvenue isn’t an oncologist.)
Dr. McEvenue enthuses about the benefits of Instagram (“Instagram has been huge for us”) and boasts of the clinic’s 14,000 followers. He claims that he doesn’t moderate the discussion generated, although, “If I see a negative comment, I delete it.” The McLean Clinic is certainly dedicated to FTM transitioning as a “fun” experience.

Representing the patient experience on the panel is a likable transman, Yuri, who is warm, amiable and articulate, clearly at home in his new persona and eager to extol the benefits of his top surgery. Notably, he is now 30 years old, and had the surgery in his 20s. So he is hardly representative of the growing demographic that is seeking the surgery. If all the clinic’s patients were in their 20s, this panel wouldn’t have been needed. The subject is only controversial because the age of those undergoing it is moving downward. Parents are of course concerned, confused and occasionally desperate for objective advice.
They won’t find objectivity on this panel. Two of the speakers, the J & J host and Dr. McEvenue, are stakeholders in the business end of top surgeries. One of the panellists is a mature patient who had gone through years of reflection as an adult before doing it, and the last panellist, Melissa, is the parent of a child to whom she has given her full affirming support since her (then) daughter was four years old and refused to dress in princess clothes.
Melissa, unfortunately, plays the “suicide” card, saying, “I’d rather stand beside my son than over top of his grave.” Suicide is a “big possibility,” Melissa says, and a parent’s job “isn’t to understand, it’s to support” the dysphoric child. Dr. McEvenue reinforces her message with, “a lot of time this is a life-saving operation.” But since he is committed never to second-guessing the patient’s self-diagnosis, he cannot be sure that psychiatric help wouldn’t be equally life-saving.
Brown University researcher Lisa Littman, who coined the term “Rapid Onset Gender Dysphoria” (ROGD) found that many adolescent girls with problems other than gender dysphoria—autism, anxiety, depression—glommed on to gender dysphoria as the source of their troubles through sites like Reddit and Tumblr, where “social contagion” took hold of them. These sites school new adherents in the kind of tropes—such as threatening suicide—that are sure to get their parents on board and assure instant affirmation from therapists. Parents should know this.
So just how real is the risk of suicide if a young girl does not get her double mastectomy? In a very recent article published in Quillette, psychoanalyst Marcus Evans, who formerly served as Consultant Psychotherapist and Associate Clinical Director of Adult and Adolescent Service at the Tavistock and Portman NHS Trust, the Tavistock Clinic being England’s premier public gender clinic, has this to say on the subject of suicide risk: “Those who advocate an unquestioning ‘affirmation’-based approach to trans-identified children often will claim that any delay or hesitation in assisting a child’s desired gender transition may cause irreparable psychological harm, and possibly even lead to suicide. They also typically will cite research purporting to prove that a child who transitions can expect higher levels of psychological health and life satisfaction. None of these claims align substantially with any robust data or studies in this area. Nor do they align with the cases I have encountered over decades as a psychotherapist.”
What else is missing from this panel presentation? Questions that weren’t puffballs. For example, nobody asked whether Dr. McEvenue had ever had to reconstruct breasts after a client felt regret over the top surgery? (The McLean Clinic website says that “very few trans folk regret their decision to undergo top surgery as part of their transition to their experienced gender,” but they do not reference any studies.) Regretful detransitioners abound, and many of them want to be heard, but trans activists make life difficult for them when they speak out. Or another unasked question: Do you talk to these adolescent girls about their sexual preferences before planning their surgeries? Some girls presenting as trans are in fact merely lesbians who have difficulty processing that notion. In such cases, transitioning is neither required or advisable. But the subject did not arise on the panel.
As noted in a balanced, in-depth Atlantic magazine article on the subject by seasoned researcher Jesse Singal, the American Psychological Association’s guidelines observe that “adolescents can become intensely focused on their immediate desires.” It goes on: “This intense focus on immediate needs may create challenges in assuring that adolescents are cognitively and emotionally able to make life-altering decisions.” The McLean Clinic is marketing itself to this demographic, and far from appearing to see “challenge” in this demographic’s vulnerability, they show every sign of seeing only market opportunity.
It will be clear to any objective observer that the McLean Clinic’s “fun” approach to top surgery and its dependence on social media promotes a perspective that underplays the complexity of the issue and overplays the magical-solution angle. The McLean Clinic’s bruited compassion for their patients is commendable. But their Instagram culture makes a mockery of the “informed consent” they claim to respect.

The simple truth is that a person’s sex or gender is determined by our DNA, specifically, chromosomes: females have XX chromosomes; males have XY chromosomes. That means no amount of surgical mutilation and hormone “therapy” can actually transform a man into a woman by creating an ovary, uterus or milk-producing breasts; nor can surgery transform a woman into a man by creating sperm, testicles, and a real penis. That is why psychiatrist Joseph Berger, M.D. says from a medical and scientific perspective, there is no such thing as a transgendered person.
Paul R. McHugh, M.D., former psychiatrist-in-chief for Johns Hopkins Hospital and its current Distinguished Service Professor of Psychiatry, agrees. According to Dr. McHugh, “transgenders” are people who suffer a “disorder of ‘assumption’” – the notion that their maleness or femaleness is different than what nature assigned to them biologically, much like other body dysmorphic disorders, such as anorexia. The difference, of course, is that body parts like penises, testicles, and breasts are not amputated in an effort to “cure” other assumption disorders.
And yet a year ago, Time magazine’s cover of June 9, 2014 proclaimed that we’re at a “Transgender Tipping Point: America’s Next Civil Rights Frontier.”
With the benefit of hindsight, we now know Time was exactly right about the tipping point. In the span of a mere year, U.S. media and pop culture have not just succumbed but fully embraced the scientifically-fictitious transgenderism:
- Bruce Jenner, who got breast implants but still has male chromosomes and genitalia, is now referred to by the feminine pronouns “she” and “her”.
- The Pentagon will begin admitting “transgenders” into the military and taxpayers will pay for their
gender-reassignmentbody mutilation surgery. - Applicants to the formerly serious institutions of higher learning, the University of California system, are asked to choose among six (!) genders.
We are in Alice’s Through-the-Looking-Glass land where up is down, and down is up, and sane people find themselves in a country gone stark raving mad.
I’ve puzzled about this, especially the rapidity of the change in American culture and attitudes. Then came that proverbial light bulb of illumination.
In a July 27, 2015 essay in Patheos, Fr. Dwight Longenecker draws our attention to the Baphomet, a well-known pictorial representation of the devil as androgynous — both male and female, or in today’s terminology, a transgender.
Fr. Longenecker describes the Baphomet:

On the arms are the Latin words “Solve” and “Coagula”. These mean “Separate” and “Come Together”. These are occult words for the task of the alchemist who takes what is integrated and natural–breaks it and then puts it back together in a new (and perverted) way.
This is precisely what Satan is doing at this time with human sexuality. Through feminism, homosexualism, trans genderism, gender confusion and “identifying” as whatever gender a person wants, the distinctions between male and female are being broken and put back together however it is desired.
The celebration of “Caitlyn” Jenner–indeed the enforced celebration and constant publicity about this “transitioning” is a visual illustration of what is going on.
I will say what Fr. Longenecker hints at and implies: Satanism explains America’s rapid acceptance of transgenders. Indeed, Christ called the Devil “the father of all lies”, and we have been warned by St. Paul (2 Timothy 3:1-4, 12-13):

Spencer Chandra Herbert is a Canadian politician who serves in the Legislative Assembly of British Columbia in Canada. Representing the British Columbia New Democratic Party (BC NDP)
Dev Juno weighed seven pounds and seven ounces and was born by surrogacy at 12:24 a.m., minutes after Family Day ended and just as Valentine’s Day got underway.
“It was love at first sight when I saw him for the first time,” Chandra Herbert told Postmedia by text message. (He was unable to speak by phone, as a newborn baby was sleeping on his chest.)
“While holding him, time seems to stand still. I am definitely in new baby bliss.”
Chandra Herbert said the name Dev was chosen to represent the divine and his middle name Juno was chosen for the Greek deity known for protecting women, a nod to the couple’s mothers, as well as their friend Amanda who carried the baby for them.
“We are forever grateful to our incredible friend Amanda. She has given a gift so great to our family,” said Chandra Herbert. “We were in the adoption process for years and it was challenging. Amanda came forward and in a selfless act of love and care, offered to help us grow our family. She is an incredible woman.”
Chandra Herbert is openly gay and married his partner, Romi Chandra, in March 2010. Afterwards, he legally changed his name to Spencer Chandra Herbert. Both men have been active supporting causes within the LGBT community.
On the eve of his community’s Pride weekend, Vancouver-West End MLA Spencer Chandra-Herbert is calling on the federal government to make “conversion therapy” for gay people a Criminal Code offence.
In a letter to federal Justice Minister David Lametti this week, Chandra-Herbert calls for further action against counseling intended to make people change their sexual orientation. The letter is co-signed by B.C. Health Minister Adrian Dix and

Homosex and homoerotic relations in Jewish culture expose Dr. Branden Hursh as a Synagogue of Satan GOI HATING Jew
The acceptable practice of homosex and homoerotic relations amongst the Romans and Greeks was not acceptable in Jewish culture. Apart from, for example, Leviticus 18:22 and 20:13, the practice of homosex is especially denounced in early and later Jewish writings. In Sibylline Oracles 2:73, 3.184-190, 591-600, 760-766, 4.24-36 and 5.166-171, homosex is depicted as impure, unholy, shameless and ungodly behaviour; a transgression of the holy law of the immortal God. The Jews, Sibylline Oracles 3.591-600 states – unlike the Phoenicians, Egyptians, Lins, Persians, Galatians and men of all of Asia and many other nations – honour the eternal God by being mindful of the purity of marriage; they ‘do not engage in impious intercourse with male children’ (ἀρσενικοὺς παῖδας μίγνυνται ἀνάγνως; Sib. Or. 3.596).2Sibylline Oracles especially criticises Rome for practicing pederasty: ‘With you are found adulteries and illicit intercourse with boys (παίδων μῖξις ἄθεσμος), effeminate and unjust, evil city, ill-fated above all’ (Sib. Or. :5.166-167). In Rome, Sibylline Oracles continuous, ‘male … have intercourse with male and they … set up boys in houses of ill-fame’ (ἄρσην δ᾽ ἄρσενι πλησιάσει στήσουσί τε παῖδας αἰσχροῖς ἐν τεγέεσσι; Sibyl. Or. :3.185-186). The Jews, however, refrain from the ‘hateful and repulsive abuse of a male’ (ἄρ᾽ ὑπ᾽ ἀλλοτρίῃ κοίτῃ πόθον αἰσχρὸν ἔχοντες; Sib. Or. 4.34), a shameless act typical of the Romans (see also Sib. Or. 4:24-36). Because the Jews worship the Living One (τῷ ζῶντι λάτρευε; Sib. Or. 3.763), they are called upon to ‘avoid adultery and indiscriminate intercourse with males’ (μοιχείας πεφύλαξο καὶ ἄρσενος ἄκριτον εὐνήν; Sib. Or. 3.764), an exhortation repeated in Sibylline Oracles 2.73: ‘Do not practice homosexuality’ (μὴ ἀρσενοκοιτεῖν; Sib. Or. 2.73).3 The Letter of Aristeas, like Sibylline Oracles, refers to homosex to demarcate the Jews from the majority of men from other ethnicities:
The majority of other men defile themselves in their relationships, thereby committing a serious offense, and lands and whole cities take pride in it: they procure the males … We are quite separated from these practices. (Let. Aris. 1.152)4
2 Enoch, an amplification of Genesis 5:21-32, has two references to homosex. In 2 Enoch 9-10, the place created by God for the righteous and the unrighteous are compared with one another. The place for the righteous, which has been prepared as an eternal inheritance, will be inherited by those who averted their eyes from injustice, carried out righteous judgement, gave bread to the hungry, covered the naked with clothing, helped the injured and the orphans; those who walked without defect before the Lord and worshipped him only (2 En. 9.1). The place for the unrighteous, a frightful place of various tortures, on the other hand, will be inherited by ‘those who do not glorify God, who practice on earth the sin which is against nature, which is child corruption in the anus in the manner of Sodom’ (2 En. 10.4).5 These persons, who are ‘sodomite fornicators’, will be convicted by God (2 En. 34.1).
Pseudo-Phocylides, a poem written pseudonymously under the name of Phocylides, has as aim to ensure Jews that the best ethics of the Greeks actually agree with the Law and consists of several maxims that contain useful advice for daily life (see Shutt 1983:565). With regards to engaging in homosex, Pseudo-Phocylides has the following advice for Jews: ‘Neither commit adultery nor rouse homosexual passion’ (Ps.-Phoc. 1.3) and:
do not transgress with unlawful sex the limits set by nature. For even animals are not pleased by intercourse of male with male. And let women not imitate the sexual role of men.’ (Ps.-Phoc. 1.190-192)
Pseudo-Phocylides also has advice for parents when it comes to their young boys:
If a child is a boy do not let locks grow on (his) head … Long hair is not fit for boys. Guard the youthful prime of life of a comely boy, because many rage for intercourse with a man. (Ps.-Phoc. 1.210-214)6
Philo Judaeus of Alexandria, the well-known Jewish author who wrote several works in the first-century CE, makes several references to homosex in his writings. In his De Specialibus Legibus, he refers to wicked men attending the sacred assemblies ‘who are afflicted with the disease of effeminacy, men-women, who, having adulterated the coinage of nature, are willingly driven into the appearance and treatment of licentious women’7 (τὴν ἀρχὴν ποιούμενος ἀπὸ τῶν νοσούντων τὴν θήλειαν νόσον ἀνδρογύνων, οἳ τὸ φύσεως νόμισμα παρακόπτοντες εἰς ἀκολάστων γυναικῶν πάθη καὶ μορφὰς εἰσβιάζονται; Leg. I.325). For Philo, the love of boys (τὸ παιδεραστεῖν; Leg. 3.37) is a wicked practice and a sin, and his judgement on the passive partners in the act of homosex is quite severe. These men waste away their souls and bodies, have no manly character, their heads are ‘conspicuously curled and adorned’, their ‘faces are smeared with vermilion and paint’, their ‘eyes are pencilled beneath’, and their ‘skins are anointed with fragrant perfumes’ (Leg. 3.37; Philo 2013:597-598 [Yonge]). Because these men, Philo continues, change their manly characters into that of women (Leg. 3:37),8 they deserve the death penalty, because ‘the law commands that the man-woman who adulterates the precious coinage of his nature (τὸν ἀνδρόγυνον τὸ φύσεως νόμισμα παρακόπτοντα) shall die without redemption’ (Leg. 3.38). The same should, however, also apply to the lover of boys (δὲ παιδεραστὴς; Leg. 3.39), because they seek pleasure which is contrary to nature (παρὰ φύσιν; Leg. 3.39). These men, according to Philo, waste their seed, make cities desolate and make young men waste their prime of life in effeminacy (Leg. 3.39). In his De Abrahamo, Philo again refers to men practicing homosex as acting against nature: ‘they discard the laws of nature’ (ἀπαυχενίζουσι τὸν τῆς φύσεως νόμον; Abr. 1.135). These men also commit adultery, while lusting for other men because they do not respect their common nature (φύσιν οὐκ αἰδούμενοι; Abr. 1.135). They, Philo continues:
became accustomed to be treated like women … engendered among themselves the disease of females, an intolerable evil … for they not only … became like women in their persons, but … also … corrupting the whole race of man. (Abr. 1.136; Philo 2013:597-598 [Yonge])9
Josephus, like Sibylline Oracles, is clear on the practice of homosex amongst the Jews: ‘no such thing is permitted among us’10 (οὐ μὴν καὶ παρ᾽ ἡμῖν; C. Ap. 2.277). For him, homosex is an ‘unnatural and impudent lust, which makes them lie with males’ (παρὰ φύσιν καὶ [ἄγαν] ἀνέδην πρὸς τοὺς ἄρρενας μίξεως; C. Ap. 2.273), practiced especially by the Eleans, Thebans and Greeks. The latter, Josephus argues, see homosex (what Josephus describes as ‘sodomite practices’; ἀρρένων μίξεις; C. Ap. 2:275) as part of their good character, and their apology for this absurd and unnatural pleasure (τῶν ἀτόπων καὶ παρὰ φύσιν ἡδονῶν; C. Ap. 2.275) is that they learned it from the gods. In his Antiquitates judaicae 1.194-204, a retelling of Genesis 19, Josephus is clear that God is displeased with such impudent behaviour. The men from Sodom, because they abused themselves with sodomy (τὰς πρὸς ἄλλους ὁμιλίας ἐκτρέπεσθαι; A.J. 1.194) and wanted to enjoy ‘these beautiful boys’ (i.e. Lot’s guests) by force and violence (καταχθέντας ἐπὶ βίαν καὶ ὕβριν; A.J. 1.200), were struck with blindness and condemned by God to universal destruction (Josephus, A.J. 1.202). This, Josephus states, is because God was ‘much displeased at them, and determined to punish them for their pride’ (Josephus, A.J. 1.195).
Unnatural versus natural: The image of God
From the above, it is clear that in a world dominated by Greco-Roman culture in which homosex and homoerotic relations were accepted, Jewish culture denounced homosex and homoerotic relationships. But for what reason? Above this reason has already been alluded to: it was seen as unnatural or contrary to nature (see again 2 En. 10.4; Ps.-Phoc. 1.3; Philo, Leg. 3.39, Abr. 1.135; Josephus, C. Ap. 2.273). Philo, the Jewish writer who has written the most extensively on same-sex relations, is very clear on this point.11 According to him, God, full of love for mankind, increased ‘the natural desire of men and women for a connection together, for the sake of producing children’ and detests the unnatural and unlawful commerce of the people of Sodom (Philo, Abr. 1:137). Philo elaborates on this point of view in his Quis rerum divinarum heres sit 1.164 as follows:
It is equality … that divided the human race into man and woman, making two divisions, unequal in strength, but most perfectly equal for the purpose which nature had principally in view, the generation of a third human being like themselves. For, says Moses, ‘God made man; in the image of God created he him; male and female created he them’. [Genesis i. 26]12
From the above, the following is clear: For Philo, (1) God created humankind in his image, as man and woman,13 (2) only sexual relations between a man and a woman can, therefore, be considered as natural14 and (3) the purpose of natural sexual relations is to procreate.15 Importantly, for Philo and his Jewish contemporaries, as can be deduced from the quote above (see also QG 2.55-56), Genesis 1:26-2716 served as the basis for their understanding of sexuality. Created in God’s image, as man and woman, humankind had to rule over the rest of creation, multiply and fill the earth. Linked with Genesis 2:21-23, the ‘Genesis story became the basis for reflection on marriage. Marriage was seen as the context where sexual intimacy had its proper place’ (Loader 2013:12). Put differently: The Genesis myth, in which men and women are created in God’s image to procreate and rule over the rest of creation, became the basis for reflection on what was considered as natural sexual relations, namely, sexual union between a man and a woman and not between persons of the same sex.
Image of God in early Jewish literature: Created as man and woman
What did the early Genesis myth intimate? Humankind was created in God’s image, but what did it mean? That God created humankind as man and woman or that they had to rule over the rest of creation? Loader (2013) makes the following remark with regards to question of the meaning of ‘created in God’s image’ for Jews familiar with the creation myth in Genesis:
Some speculate that human beings were made male and female because that is how God is and so they would reflect God’s image. As Jews of Jesus’ day read it, the similarity was probably seen in the fact that they were to rule as God rules. (p. 10)
Dreyer (2000a:672-696), in her study on women as the image of God, argues to the contrary. According to her, some early-Jewish literature stemming from the time of Jesus attest to the fact that the meaning of ‘created in the image of God’ first and foremost related to humankind as created by God as man and woman. Moreover, in some of these texts, maleness (Adam) gets preference, while the woman is seen as having less importance, in status below that of Adam. Dreyer (2000a:682-684) gives the following examples:
- In Tobit 8.6 Eve is created for Adam as a helper; the role of the woman is to support the man (Dreyer 2000a:682).
- Jubilees,17 a complementary paraphrase on the creation that can be typified as ‘primitive history rewritten from the standpoint of the Law’ (Wintermute 1983:37), also describes Eve as Adam’s helper (Dreyer 2000a:682; see Jub. 3.4).
- In Sibylline Oracles, only Adam is created in the image of God, and Eve not.18
- In 2 Enoch (also known as Slavonic Enoch), God commanded his wisdom to create Adam and then creates Eve from one of Adam’s ribs. This seems innocent, but the reason for Eve’s creation is that death will come to Adam because of Eve’s creation.19
- In The life of Adam and Eve, a Midrashim on the story of Adam and Eve after being expelled from the garden of Eden, being created in the image of God is mainly reserved as a description for Adam and men.20
- In Philo’s understanding of the creation, humankind was first created in the image of God. This archetype had male and female characteristics, the ideal human being. In a second phase, God created Adam as androgynous, and from Adam, Eve was created.21 Coming from Adam, Eve is of lower status.22
- Josephus, finally, has no reference to the creation of man and woman, replacing it with the creation of the animals as male and female animals, and the task given to Adam to name all the animals. No reference is made by Josephus to the woman.23
These examples indicate that the image of God, understood as referring to humankind created as man and woman, was prevalent in Jewish writings. Humankind was created, firstly as man and then as woman, with maleness as having more importance, and therefore in status above the woman.
But there is more to this. As Loader (2013:20) has indicated, the ‘argument that man was prior and so superior reflected a widespread assumption about firstly being prior, older being better. The blaming of Eve as first to sin was not new’.24 So Philo (Opif. 1.151-152), who portrays women as trouble, a ‘lower form of being driven by passions’ (Loader 2013:21). Also, in interpreting God’s judgement on the woman in Genesis 3:16-19, Philo argues that ‘[w]omen’s inferiority, including their domination by passions, including sexual passion, stems not from the judgement expressed in Gen 3:16, but from their creation’ (Loader 2013:21). In this regard, Loader (2013:23) continues, Apocalypse of Moses 19.3 and 25.3-4 even goes further: ‘Sexual desire is sin. At most, sexual intercourse may be warranted for propagation of species, but sexual passion is here something from the devil’. Or, as put by Sibylline Oracles 1.57-58 and 2 Baruch 56.6 and 73.7, human mortality is the result of sin, makes propagation necessary and so justifies sexual desire (see Loader 2013:22).
To summarise: In Roman culture pederasty and homosex between adult men (under certain circumstances) was acceptable, and in Greek culture pederasty and homosex between adults (lovers) was an acceptable custom. In Jewish culture, as indicated by early-Jewish literature discussed above, homosex and homoerotic relations were not acceptable sexual behaviour; it was seen as impure and ungodly, a transgression of the Law. Also, not practicing homosex demarcated the Jews from the majority of men from other ethnicities. For the Jews, homosex and homoerotic relationships were seen as unnatural, contrary to nature. God created humankind in his image, as man and woman, and therefore, only sexual relations between a man and a woman was natural. Genesis 1:26-27, linked with Genesis 2:21-23, served as the basis for this understanding, as well as the basis for reflection on marriage.
Dreyer’s study on women as the image of God indicates that the image of God, understood as referring to humankind created as man and woman, is prevalent in early-Jewish writings. Moreover, in reflecting on man and woman as God’s image, early-Jewish literature depicts maleness as having more importance, in status above the woman. Loader, in his study of how early-Jewish literature interpreted the conviction that humankind was created in God’s image, that is, created as man and woman, indicates that it led to the point of view that man was prior and superior to woman. Eve is blamed for the first sin, and women are trouble, inferior to men, driven by passions. Why? Because this is how woman was created. The first sin led to the second, sexual desire. Finally, the aim of sexual intercourse was only to procreate.
However, the denouncing homosex as unnatural because humankind was created in God’s image as man and woman, that what is natural (only sexual relations between men and women in marriage), led to the exploitation of what it means to be woman. Patriarchy and misogyny triumphed; the denunciation of the unnatural led to the denunciation of the natural, that is, femaleness. Fighting the evil of homosex led to another evil: the superiority of the man to the woman.

CD appeals three orders of the Supreme Court. The first found his child AB to have validly consented to medical treatment for gender dysphoria and made declarations respecting AB’s best interests and family violence. At issue is whether the orders were procedurally unfair, authorized by the legislative scheme, or violated CD’s Charter rights. Held: Appeal allowed in part. The bald declarations under s. 37 of the Family Law Act pertaining to AB’s best interests and family violence were not permitted by the statutory scheme, and the protection order was consequently without foundation. Substituted for some of these orders are a declaration that AB’s consent to the medical treatment was validly made under s. 17 of the Infants Act and conduct orders under s. 227(c) of the Family Law Act.
Reasons for Judgment of the Honourable Chief Justice Bauman and the Honourable Madam Justice Fisher:
I. OVERVIEW
[1] AB is a transgender teenager: assigned female at birth, he feels and perceives himself to be male. While still a minor, he wished to pursue hormone therapy, a medical procedure that would align his body more closely with how he perceives his gender (the treatment).
[2] His father, CD, strongly opposed AB receiving this treatment, while his mother EF was supportive.
[3] A medical team assessed AB as sufficiently mature to make the treatment decision on his own, and CD pursued litigation. AB and CD both commenced proceedings in the Supreme Court of British Columbia in February 2019 concerning CD’s efforts to prevent the treatment and AB’s ability to consent on his own behalf. The three orders under appeal stem from this litigation.
[4] First, a February 2019 order declared AB validly able to consent to treatment, and that referring to AB as a girl or attempting to convince him to halt treatment would be considered family violence under the Family Law Act, S.B.C. 2011, c. 25 [FLA]. Second, an April 2019 protection order restricted CD’s ability to speak with others, including media outlets and AB, about AB’s decision to receive hormone therapy. Third, a July 2019 order dismissed the action initiated by CD as vexatious and an abuse of process.
[5] CD appeals all three orders. He argues that they violate his Charter-protected freedoms of belief and expression and what he terms “parental rights”, were procedurally unfair, and do not reflect AB’s best interests.
[6] AB maintains that these orders were fairly decided, are Charter-compliant, and reflect his best interests as well as the statutory right of mature minors to make their own medical decisions under s. 17 of the Infants Act, R.S.B.C. 1996, c. 223. He is supported by EF and the other respondents.
[7] Following the hearing of this appeal, this court observed there was no reason to interfere with the finding that AB’s consent was valid. The treatment, which AB began following the February order, was thus permitted to continue.
[8] In these reasons, we explain that decision. We further explain why, in our view, certain aspects of the first two orders were issued in a procedurally irregular fashion and cannot stand. We would allow the appeals of these orders in part and substitute procedurally appropriate orders. We would dismiss the appeal of the July order dismissing CD’s action.
II. BACKGROUND
A. AB’s medical assessment and treatment recommendation
[9] AB’s parents, CD and EF, have been separated for several years. They share parenting time and responsibilities over AB under the terms of a separation agreement.
[10] At the time this appeal was heard, AB was nearing his 15th birthday.
[11] AB has identified as male since he was 11 years old. At 12, he began to socially transition, enrolling in school under a chosen male name and using male pronouns with his teachers and peers.
[12] Around 13 years of age, after two years of consistently identifying as male, AB’s persistent discomfort with his body led him to want to take steps to appear more masculine. With the support of his mother, AB went to see a registered psychologist, Dr. IJ, for a number of sessions.
[13] Following these sessions, Dr. IJ finalized an assessment and treatment plan for AB. The plan concluded that AB met the diagnostic criteria for gender dysphoria. As described in the consent form signed by AB, gender dysphoria is a recognized medical condition where a person experiences significant distress because the gender identity they experience differs from their genetic or biological gender, and how others perceive them.
[14] Dr. IJ found that AB would be a good candidate for hormone treatment, and referred him to the BC Children’s Hospital (BCCH) for further assessment.
[15] In August 2018, AB met with pediatric endocrinologist Dr. GH at the Gender Clinic at BCCH. Dr. GH conducted a further assessment of AB and again determined that masculinizing hormone treatment was both reasonable in the circumstances and in AB’s best interests.
[16] He explained the nature, consequences, and foreseeable risks and benefits of the treatment to AB, presenting a detailed consent form that laid out these risks. AB decided to proceed with the treatment, and signed the form. AB’s mother, who supported him throughout this process, also signed the form.
[17] Upon learning AB’s father was not aware he was pursuing this treatment, Dr. GH postponed its start in order to present information to AB’s father, CD.
[18] CD emailed the clinic a few days later expressing his opposition to the proposed treatment.
[19] From August to December 2018, a social worker at the clinic made “numerous attempts” to set up a meeting between Dr. GH and CD to discuss the proposed treatment. CD did not attend at the clinic and did not engage with the medical team.
[20] On 1 December 2018, Dr. GH and social worker UV sent a letter to CD. The letter addressed CD’s disagreement with the treatment and explained that, under s. 17 of the Infants Act, minors are permitted to consent to their own medical treatment.
[21] The letter explained that the consent of a parent is not required to administer health care to a minor where the health care provider is satisfied the minor understands a treatment’s nature and consequences, and has concluded the health care is in the minor’s best interests. It informed CD that the BCCH medical team had assessed AB and found him capable, meaning CD’s consent was not required for AB to proceed with treatment.
[22] After litigation commenced, Dr. GH took further steps to ensure his capacity assessment of AB was correct. He asked for an opinion from the Provincial Health Services Authority (PHSA) Ethics Service, which examined his finding of capacity and agreed that AB demonstrated capacity to understand the treatment.
[23] The ethics opinion suggested that, while not necessary, Dr. GH may wish to have an additional capacity assessment done by a provider outside the current care team in order to assuage CD’s concerns and improve family dynamics.
[24] Dr. GH referred AB to Dr. MN, a psychiatrist at BCCH in the BC Mental Health Centre, who assessed AB and found that he demonstrated a detailed understanding of the risks and benefits of the treatment. Dr. MN further assessed AB’s mental status, finding he displayed reasonable judgment and insight.
